Damages in a Graham Motor Vehicle Collision

Most plaintiffs in a Washington State car collision can be eligible for two different types of compensatory damages, both of which are aimed at compensating a plaintiff for her losses in the crash:

  • Economic damages, which provide compensation for economic losses that are objective in nature, such as wages lost due to the inability to work or costs of hospital bills from surgery, treatment, and recovery; and
  • Non-economic damages, which provide compensation for non-economic losses that are subjective in nature, such as a plaintiff’s pain and suffering from the car accident injuries or a plaintiff’s loss of enjoyment of life due to a disabling injury.

Comparative Fault in Graham Car Collisions

What will happen to your damages award if the at-fault driver alleges that you bear some responsibility for the accident or for the severity of your injuries? Under Washington State’s contributory fault law, a plaintiff is not barred from recovery even if that plaintiff is partially at fault. A plaintiff can recover damages under this law whether that plaintiff is as little as 1 percent at fault or 99 percent at fault. However, as the statute explains, “any contributory fault chargeable to the claimant diminishes proportionately the amount awarded as compensatory damages for an injury attributable to the claimant’s contributory fault.”

How does this law work in practice? For example, if a plaintiff is awarded $500,000 in compensatory damages but is found to be 10 percent at fault, the plaintiff’s damages award would be diminished by her own contributory fault. Accordingly, the $500,000 damages award would be reduced by 10 percent, or $50,000. Then the plaintiff would recover a total of $450,000. You should keep in mind that, even if a defendant alleges contributory fault, your damages award will not necessarily be reduced. Contributory negligence is a defense that the at-fault driver can try to use to reduce the amount of damages they will have to pay. We can present evidence to show that you were not at all at fault.

While some states will bar a plaintiff’s recovery if the plaintiff is even 1 percent at fault and others will bar a plaintiff’s recovery if that plaintiff is 50 or 51 percent at fault, Washington State does not bar a plaintiff’s recovery this way.
