Elements of a Personal Injury Claim

Those who have been injured may not know whether or not their injuries and the details surrounding their accident make filing a personal injury claim appropriate. Again, our lawyers are here to answer any questions that you have and guide you through the process of bringing forth a suit. It’s important to know that merely being injured–even if those injuries are indeed serious–does not in itself mean that you have a personal injury claim. Instead, a personal injury claim is only appropriate when the actions of one party lead to the harm of another. Even then, there are four elements of a personal injury claim that must be established in order for a jury to award damages. These are:

  • The plaintiff was owed a duty of care by the defendant. Often, the duty of care that exists between a plaintiff and a defendant is implied in a personal injury case. In short, “duty of care” just means that the defendant had some sort of responsibility to act in a certain way toward a defendant. For a driver, this means operating a vehicle safely; for a property owner, this means maintaining the property in a safe condition; etc.
  • The defendant failed to exercise the duty of care owed to the plaintiff. The second element that must be established is that the defendant failed to exercise the duty of care owed to the plaintiff. Using the two examples above, perhaps the owner of a vehicle operated their vehicle unsafely, choosing to speed instead of adhering to the limit. Or perhaps a property owner failed to remedy a dangerous condition on their property–such as a hole–and failed to give the plaintiff warning of the condition when they entered the property.
  • The negligence caused the accident. The breach of the duty of care is referred to as negligence. Once negligence has been established, the next step is proving that the accident would not have occurred but for the negligence. In other words, the car accident would never have occurred had the defendant not been speeding. This is referred to as causation.
  • The plaintiff suffered damages. You’ll also need to prove that you, the plaintiff, suffered actual damages as a result of the accident.
