PROVING PERSONAL INJURY DAMAGES IN RENTON, WA

In order to win a personal injury case, it is not enough to show that you were injured. You must also prove that the defendant’s negligence led directly to your injuries. This can be difficult to prove, especially in workplace accidents and slip and fall cases. At Khan Law Firm, PLLC, our Renton personal injury lawyers help our clients gather the proper evidence needed to achieve a successful outcome to a personal injury case. Essential evidence includes:

  • Photographic evidence from the accident. Photographic evidence is absolutely necessary if you hope to win a personal injury case stemming from a car or truck accident. You will need to show photos of the vehicles after the accident, the location of the debris, and the street conditions at the time of the accident. While photographs are an important piece of evidence in car accident cases, they also serve a beneficial purpose for other types of accidents, such as snowmobile accidents, motorcycle accidents, boating accidents, jet ski accidents, bicycle accidents, and nursing home abuse (photos of bruises, torn clothing, etc.).
  • Police reports of the accident. Another essential piece of evidence in a personal injury case is police reports. If possible – and especially after a car accident – be sure to retain an accurate and detailed copy of the police report. If you feel that the attending officer did not accurately document the accident, or that they missed a key piece of information, ask them to include it before finalizing the report.
  • Eyewitness statements. In order to keep your personal injury case from going the “he said, she said” route, try to get eyewitness statements if possible. Right after the accident occurs, try to get the names and contact information of any passerby or witnesses so that you may contact them later on down the road to testify on your behalf.
  • Medical records. Without medical records dating from soon after your accident, your personal injury case is nonexistent. Do not delay in seeking medical attention after your accident, and once you do visit a doctor or specialist, make sure that they keep accurate documentation of your condition, the treatment they prescribe, and the treatment’s effect on your condition.
  • Proof of missed work. Lost wages oftentimes make up a significant portion of a person’s personal injury damages, so it is important that you get documentation of the amount of days missed due to the accident and injuries sustained.
  • Written documentation of how your injuries affect your daily life. Finally, try to keep a daily journal of life after the accident. Pain and suffering damages are another major component of personal injury claim damages, so the more proof you can provide of how your injuries have negatively affected your life, the better.

Statute of Limitations on Personal Injury Lawsuits in Washington

Every state has a statute of limitations on personal injury lawsuits. In the State of Washington, the timeframe in which an individual must file a personal injury claim is three years. If an individual fails to file within three years, they lose all chance of ever recovering compensation for injuries sustained during an accident. However, the three years may start on the date of the accident or on the date that the injury is discovered. For instance, if an individual has evidence that they had no back troubles prior to the accident, but then develop back pain after the accident, they may not visit a specialist until their back pain becomes debilitating. For some individuals, this could take months or years. If an approved specialist discovers a newly developed back condition, the statute of limitations would start on the date of injury discovery.
